Breaking: Court nullifies impeachment of former Kogi deputy governor

- Simon Achuba's removal as the Kogi state deputy governor has been declared illegal

- Justice John Olorunfemi of the state high court in his judgement said Achuba's removal violated the constitution

- Back in 2019, the Kogi state House of Assembly impeached the deputy governor

The removal of Simon Achuba, former Kogi deputy governor by the state House of Assembly has been declared null and void by a state high court in Lokoja.

According to Channels TV, Justice John Olorunfemi while delivering the judgment on Wednesday, February 26, said Achuba’s removal is a violation of the constitution.

He further described the state House of Assembly's action as a constitutional coup, hatched and executed in a democracy.

Justice Olorunfemi went on to note that Achuba's removal was contrary to a section of the constitution that stopped the House from taking action having discovered that the former deputy governor was not found wanting. The judge pointed out that the 29th defendants also did not file a counter-notice.

The former deputy governor was impeached by members of the Kogi state House of Assembly back in October 2019.

Meanwhile, Legit.ng previously reported that Achuba, insisted that he is still the state's number two citizen despite his impeachment by the legislature.

The ousted deputy governor of Kogi said anyone parading himself as the deputy governor is an impostor who should be jailed by security agencies without delay. He disclosed this during an interview with Channels Television on Thursday, October 24.

In a related development, the impeached deputy governor of Kogi state, has sued Governor Yahaya Bello and the state attorney general. He alleged that the governor refused to pay him his salary and allowances.

The suit marked: NICN/ABJ/244/2019 was filed before the National Industrial Court in Abuja. Among other things, Achuba wants the court to declare that he is “entitled to all the rights and privileges of the office of the deputy governor of Kogi state of Nigeria.
